1. General Provisions
These Terms of Use govern the use of the website jovanacajovicstudio.com (hereinafter: the “Website”), operated by ČAJOVIĆ PR SLIKARSKI ATELJE JOVANA ČAJOVIĆ STUDIO NOVI SAD (hereinafter: the “Studio”).
By using the Website, each user confirms that they have read and understood these Terms and agree to their application.
2. Purpose of the Website
The Website is intended for presenting the Studio’s design works, as well as for ordering and purchasing carpets and other products created according to the Studio’s designs.
The sale of products through the Website is intended exclusively for legal entities (companies, entrepreneurs, and other organizations). The Studio does not sell products to natural persons – consumers within the meaning of the Consumer Protection Act.
3. Ordering and Conclusion of Contracts
Orders are placed electronically, either by submitting a request through the Website or via e-mail. A contract between the Studio and the Buyer (a legal entity) is considered concluded at the moment the Studio confirms receipt of the order via e-mail.
The Buyer is responsible for providing accurate and complete information when placing an order (company name, tax identification number, address, contact person, delivery details). The Studio is not liable for any consequences resulting from the provision of inaccurate or incomplete information.
4. Prices and Payment
Product prices are quoted in euros, excluding value-added tax (VAT), as the Studio is not registered for VAT.
Payment is made in the manner agreed with the Buyer, by transferring the price to the Studio’s current account, in the local currency equivalent calculated at the NBS middle exchange rate on the day of payment. Details regarding deadlines and payment schedule will be specified in the order confirmation and/or contract.
5. Delivery and Collection
Products can be collected in person at the Studio’s address or sent via courier to the Buyer’s address at the Buyer’s expense, unless otherwise agreed.
The risk of accidental loss or damage to the products passes to the Buyer at the moment the products are handed over to the courier service or collected in person.
6. Liability for Quality
Carpets are produced according to the template and design prepared by the Studio. The Studio is responsible for the quality of the craftsmanship and the authenticity of the design.
Complaints are accepted within the timeframe and in the manner agreed between the Studio and the Buyer, and the Studio undertakes to review and handle them in accordance with good business practices and the law.
7. Use of the Website
All content on the Website (texts, photographs, graphic designs, carpet designs) constitutes the intellectual property of the Studio and is protected by copyright.
Unauthorized copying, reproduction, distribution, or any other use of the Website’s content without the prior written consent of the Studio is not permitted.
8. Limitation of Liability
The Studio makes efforts to ensure that all information on the Website is accurate and up-to-date, but does not guarantee complete accuracy and assumes no responsibility for any potential errors.
The Studio is not liable for any interruptions in the operation of the Website, technical issues, or the inability to access the Website due to circumstances beyond the Studio’s control.
9. Force Majeure
The Studio is not liable for delays or failure to fulfill obligations due to circumstances constituting force majeure (war, natural disasters, epidemics, strikes, supply interruptions, government decisions, etc.). In such cases, the Studio is obliged to inform the Buyer of the occurrence of force majeure and to fulfill its obligations as soon as the circumstances cease.
10. Data Protection
If data about representatives of legal entities (name and surname, e-mail, phone number) is collected through the Website, it is used exclusively for communication and order processing purposes. The Studio takes all reasonable measures to protect this data and does not share it with third parties, except where required by law.
11. Amendments to the Terms
The Studio reserves the right to amend these Terms of Use at any time by publishing a new version on the Website. Amendments take effect on the date of publication.
12. Jurisdiction
The law of the Republic of Serbia shall apply to all relations between the Studio and users of the Website.
The competent court in Novi Sad shall have jurisdiction to resolve any potential disputes.
